WCI Conference 2024

Timothy Pedergnana spoke at the WCI Conference in Orlando, Florida on August 20, 2024 regarding integrity in the handling of foreign claims asserted under the Defense Base Act. The panel addressed the handling of foreign national claims, current trends, and recommended solutions to protect all stakeholder interests. Mr. Pedergnana focused on investigative and litigation defense strategies for employers and carriers as the industry experiences a wave of international claimants filing successive claims after initial settlements.

USDOL East Coast DBA Symposium 2024

Keith L. Flicker spoke at the United States Department of Labor's East Coast Defense Base Act Symposium in New York City on July 18, 2024 on developing trends and protocols in war hazard reimbursements and their impact on DBA industry stakeholders.

WCI Conference 2023

Stephanie Gorin attended the WCI Conference in Orlando, Florida, on August 22, 2023 to discuss an industry- wide surge in respiratory claims. The panel addressed emerging trends in Defense Base Act litigation involving exposure to alleged toxins and resultant injuries, with Ms. Gorin speaking on strategies to defend claims filed against employers and carriers.

USDOL East Coast DBA Symposium 2023

Keith L. Flicker will speak at the United States Department of Labor’s first annual East Coast Defense Base Act Symposium in New York City on June 13, 2023 on the topic of Defense Base Act waivers for injured local and/or third country national workers. Mr. Flicker will address the requirements that must be met in order for DBA waivers to be applicable to such workers and the impact that these waivers have on the Defense Base Act industry.

USDOL East Coast DBA Symposium 2023

Richard L. Garelick will present at the United States Department of Labor’s inaugural East Coast Defense Base Act Symposium in New York City on June 13, 2023 on “Appropriate Compensation in the Post Afghanistan World.” Mr. Garelick will discuss the methodology that should be utilized in calculating an injured worker’s average weekly wage in consideration of the withdrawal of American military personnel from Afghanistan in August 2021.

Longshore Conference 2023

Brendan E. McKeon presented at the Annual Longshore Conference in New Orleans, Louisiana on March 24, 2023 on the topic “Burn Pit Litigation.” The panel addressed emerging trends in Defense Base Act litigation involving exposure to burn pits overseas, with Mr. McKeon speaking particularly on strategies to defend claims filed against employers and carriers.

Keith L. Flicker spoke at the WCI Conference in Orlando, Florida on August 23, 2022 on the topic “The Ukraine Crisis: Shaping the Future of the Defense Base Act Industry.” The panel discussed the anticipated need for private contractors in Ukraine for both security and infrastructure support, concerns regarding Defense Base Act insurance policy underwriting, and the impact of the use of private contractors in Ukraine on the Defense Base Act community.

Flicker presented at the Annual Longshore Conference in New Orleans, Louisiana on March 24, 2022 on the topic “Foreign Claimants, Foreign Laws, and the Interplay with Federal Compensation Acts.” The panel addressed the interplay between the Defense Base Act and foreign laws and the recent positions taken by the Office of Administrative Law Judges concerning Defense Base Act claims involving foreign claimants.
